Our society owes every senior citizen care that allows him or her to live safely and with dignity. Unfortunately, elder abuse, a term that encompasses physical and emotional mistreatment by caretakers; fraud and financial exploitation by relatives, brokers, and salespersons; and nursing home abuse and neglect, is far too common.

Forms of elder abuse

Elder abuse can occur when the victim resides in a nursing home or assisted living facility, but it may also occur when a person is living at home and independent, when a relative or nurse is providing assistance with financial or daily tasks. Colorado State and federal laws contain provisions to protect vulnerable adults from a variety of forms of abuse:

Nursing home neglect: The most common form of elder abuse is the result of negligence on the part of nursing home administrators, negligence that results in abuse and neglect of residents under their care.

Financial abuse: a common and broad category of actions by relatives, acquaintances, salespersons, and professionals, who take advantage of an elderly person's limited experience, misplaced trust, lack of mobility, or diminished capacity. Examples include: misuse of a power of attorney or checking account, fraud, selling an inappropriate life insurance policy to a senior, making an unauthorized investment or transaction, and coercing a person to sign a document or change the terms of a will.

Other Types of Physical abuse: In addition to neglect, abuse may include hitting, pushing, slapping, or sexual assault by home health care aides, family caretakers, and staff in nursing homes and assisted living facilities. Any bruise, fracture, laceration, or sore requires a good explanation.

Emotional abuse: If you observe that an elderly acquaintance or relative has become nervous, depressed, or accuses a caretaker or nursing home aide of being verbally abusive, it is a red flag. You should contact an attorney with experience in elder abuse cases and ask about an investigation.
